Notice to Architect Applicants: If you are offering or proposing architectural services prior to licensure, please review the requirements for solicitation prior to licensure in Rule 2.7. Individuals meeting the conditions of Rule 2.7 are prohibited from rendering additional architectural services beyond the offer or proposal until the individual has an active license.

Proposed Rules

This is an official notification to all Mississippi-registered architects of important proposed rule changes.  The Mississippi State Board of Architecture recently adopted new and revised rules that were filed with the Mississippi Secretary of State on May 7, 2024.  Please review the proposed rules (see link above), which will:

  • Amend Rule 2.1.1 to exempt Mississippi residents from the application/registration fee for initial registration.
  • Add Rule 3.2.8.1 to specifically allow a non-resident architect, who is not registered in Mississippi but is registered in another state, to serve as a consultant to an architect registered in this state if all construction documents and specifications are prepared under the responsible control of and are signed and sealed by the Mississippi-registered architect.
  • Amend Rule 3.2.16, regarding construction administration services, to clarify the wording and add the Board of Architecture to the list of individuals and entities who must be notified if an architect is not providing construction administration services for a project.
  • Amend Rule 4.3.5 to bring the rule into conformity with Miss. Code Ann. § 11-75-1 (the Mississippi Architects and Engineers Good Samaritan Act), which was enacted during the 2022 regular legislative session.
  • Amend the responsible control requirements in Rule 4.5.2 to clarify the requirements and address the use by an architect of third-party off-site drafting services.
